Pole Fluency Coaching (PFC) — Terms of Purchase
Effective date: December 1, 2025
By completing your purchase, you agree to these Terms of Purchase ("Terms") with Flow Movement LLC ("we," "us," "our"). These govern PFC cohort enrollments offered via our checkout (ThriveCart or equivalent) and delivered across our platforms (e.g., Thinkific, Zoom, Slack).
---
1) What you’re buying
- Access to the Pole Fluency Coaching (PFC) program as described on the sales page for your cohort, including stated modules, live sessions or replays, community access if included, and resources.
- Delivery begins after purchase based on the cohort schedule and ends per the program timeline. See Sections 9 and 11 for refunds and availability.
2) License and permitted use (program is licensed)
- You receive a personal, non‑exclusive, non‑transferable, revocable license to use PFC materials for your own learning. If the program explicitly grants a teaching license, that license is separate and subject to additional requirements and a separate agreement.
- No redistribution: Do not share, resell, upload publicly, post, or otherwise distribute program materials, logins, or downloads.
- Certification or any teaching license is contingent on successful completion of all requirements and our approval.
3) Intellectual property; brand and trademark usage
- All content, curriculum, brand elements, recordings, and materials are owned by Flow Movement LLC or its licensors and protected by applicable IP laws.
- Use of “Pole Fluency Coaching,” “PFC,” and related marks is governed by our trademark guidelines. You may reference PFC solely as permitted (e.g., accurate statements of completion). Do not imply partnership, endorsement, or credentials beyond what you have earned. No confusingly similar marks, registrations, or derivative branding.
4) “No duplication of training” clause
- You agree not to reproduce, adapt, translate, reverse engineer, teach, train, or create derivative trainings, curricula, courses, or teacher certifications based on PFC materials, methodology, or assessments, in whole or in part, without prior written permission. This includes any train‑the‑trainer, licensing, franchising, or credentialing of others.
5) Community conduct and access
- Be respectful, lawful, and supportive in all program spaces. We may suspend or remove access for harassment, illegal conduct, IP violations, or other material breaches. See Section 13 for termination.
6) Health and participation waiver; not medical advice
- Movement training involves physical activity and risks. You assume all risks of participation and release Flow Movement LLC and instructors to the fullest extent permitted by law.
- Nothing in the program constitutes medical, physical therapy, or professional advice. Consult a qualified healthcare provider as needed.
7) Recordings and media consent
- Sessions may be recorded. By participating, you consent to recording and grant us a license to use your image, voice, and likeness in program replays and educational materials unless you opt out in writing before the session.
8) Payments, plans, failed payments, and chargebacks
- You agree to pay the full amount, including taxes/fees, whether paid in full or via a payment plan. Payment plans authorize scheduled charges until the balance is paid.
- Failed payments: We may retry charges and suspend access until resolved.
- Collections: If your balance remains unpaid, we may assign the account to collections and you are responsible for reasonable collection costs, fees, and attorney’s fees as permitted by law.
- Chargebacks: You agree not to initiate a chargeback except in cases of confirmed fraud. Improper chargebacks remain your responsibility including processor fees and our reasonable dispute costs.
9) Refunds, cancellations, transfers, and deferrals
Life happens — I get it.
Here’s how cancellations and refunds work, in the simplest, cleanest terms:
BEFORE the program begins:
Up to 14 days before the start date: You can receive a full refund, no questions asked.
Less than 14 days before the start date: Refunds are available minus a $100 administrative fee (this covers prep and materials already allocated).
AFTER the program has begun:
Because all participants receive immediate access to training materials and coaching support, refunds after the start date are generally not offered.
However: Refund requests after the program begins are reviewed on a case-by-case basis.
Serious or unforeseen life circumstances may allow for support options.
To keep everything fair and clear: Non-participation or becoming “too busy” is not considered a valid reason for a refund.
If you need to step out mid-training:
You won’t lose your investment.
You may apply the amount you’ve paid toward another Flow Movement program within 24 months.
This gives you flexibility and ensures the spot you occupied can be reallocated without financial harm to the program.
---
PAYMENT PLANS
Payment plans are a commitment to the full tuition amount.
If you’re on a plan and need to step out of the training, your payments continue, and you still retain full credit toward a future Flow Movement training.
---
TRANSFER POLICY
You may transfer your registration to another participant with approval from Flow Movement®.
Financial exchange for a transfer is handled between participants.
---
Cancellation by Flow Movement
If we cancel the training, you receive a full refund.
10) No guarantees
- We do not guarantee specific results, earnings, client outcomes, or certification. Your success depends on participation and application.
11) Access window; availability; live vs prerecorded
- Access window: Unless otherwise stated on the sales page, you have lifetime access to program materials.
- Replays: Unless otherwise stated, replays are available for 90 days after the final live session and may be archived thereafter.
Sales page controls if different.
- Live vs prerecorded: Program elements may include a mix of live sessions and prerecorded materials. We may substitute replays/prerecorded content when a live session cannot run as scheduled; such substitution satisfies our delivery obligation for that session.
- Platform changes: Delivery platforms/formats may change when reasonably necessary without materially reducing access during your window.
12) Technology and availability
- We aim for reliability but do not guarantee uninterrupted availability.
13) Termination for breach; right to deny service
- We may deny or terminate participation for misconduct, policy violations, or risk concerns. Material breach may result in termination without refund.
14) Disclaimers; limitation of liability; indemnity
- Provided “as is” and “as available.” To the extent permitted by law, we disclaim warranties and limit liability for indirect, incidental, special, or consequential damages. Our total liability shall not exceed the amount you paid for the program.
- You agree to indemnify and hold us harmless from claims, damages, or expenses arising from your misuse of the program or breach of these Terms.
15) Privacy and data handling
- We process your data per our Privacy Policy for program delivery and account administration. See the Privacy Policy linked at checkout.
16) Changes to these Terms
- We may update these Terms when reasonably necessary. Material changes will be signaled by updating the effective date and, where feasible, notifying enrolled participants.
17) Governing law; disputes
- These Terms are governed by the laws of Colorado, USA. Venue lies in state or federal courts in Boulder County, Colorado. Before filing suit, both parties agree to attempt informal resolution by written notice and allow 30 days to respond.
